⚠️

STRO Licensing is Mandatory — No Exceptions

Operating a vacation rental in San Diego without a valid STRO license is illegal and subject to fines up to $1,000 per violation. Platforms like Airbnb and VRBO require valid licenses before listing properties. Non-compliance puts your entire rental operation at risk of immediate citation and delisting. Understanding the System

San Diego’s Four STRO License Tiers

Which tier you need depends on your property location and how you intend to rent it. Most vacation rental investors need Tier 3 or Tier 4.

Tier 1
Limited Home Share
20 Days or Less Per Year
  • Must be your primary residence
  • Maximum 20 rental days annually
  • Home share only — you’re present
  • License valid 2 years
Best for: Homeowners who occasionally rent a room or space while living in the property — not for investors.
Tier 2
Extended Home Share
More than 20 Days Per Year
  • Must be your primary residence
  • Must occupy property 275+ days/year
  • Home share only — you’re present
  • No rental day limit
  • License valid 2 years
Best for: Homeowners who frequently rent rooms while maintaining primary residence status.
Tier 3
Whole Home — Citywide
Investment Properties Outside Mission Beach
  • Whole home rentals allowed
  • Minimum 2-night stay required
  • Does NOT need to be primary residence
  • License valid 2 years
  • Capped at 1% of city housing units (~5,000 total)
Best for: Investment properties in La Jolla, Pacific Beach, Ocean Beach, Point Loma — anywhere outside Mission Beach.
Tier 4
Whole Home — Mission Beach
Mission Beach Properties Only
  • Whole home rentals allowed
  • Minimum 2-night stay required
  • Does NOT need to be primary residence
  • License valid 2 years
  • Capped at 30% of Mission Beach housing (~1,000 total)
Best for: Mission Beach investment properties — higher cap reflects the neighborhood’s long tourism history.

Ongoing Obligations

Key STRO Compliance Requirements

Obtaining a license is just the start. These are the ongoing obligations that keep you legal and in good standing with the City of San Diego.

📋

Valid STRO License

Every rental must have an active license matching the correct tier. Licenses expire after 2 years and must be renewed. Operating with an expired license triggers immediate fines and platform delisting.

Violation: $1,000+ per incident
💰

TOT Tax — 12.75%

Most areas we serve require 12.75% Transient Occupancy Tax on all reservations under 30 days. You must obtain a TOT certificate, collect from guests, and remit monthly to the city. Late payments incur penalties starting at 1% plus 1/3% daily.

Late penalty: 25% + interest
🗓️

2-Night Minimum

Tier 3 and Tier 4 licenses require minimum 2-night stays. One-night bookings are prohibited for whole-home rentals. This rule aims to reduce party rentals and maintain neighborhood character. Even accidental violations count.

Violation: license suspension risk
👤

One License Per Person

Individuals are limited to one STRO license. However, LLCs, trusts, and corporations can each hold separate licenses — allowing strategic ownership structures for owners with multiple properties.

📍

License Display Required

STRO license numbers must be displayed prominently in all listing descriptions on Airbnb, VRBO, and other platforms. Platforms verify license validity and will delist properties with expired or missing license numbers.

Missing: immediate delisting
🤝

Good Neighbor Policy

Maintain good standing by enforcing quiet hours, managing guest complaints promptly, and avoiding verified violations. Multiple complaints within 2 years can jeopardize license renewal and result in revocation.

3 violations: non-renewal risk
Avoiding Penalties

Common STRO Violations and Their Penalties

These mistakes cost owners thousands in fines and can permanently jeopardize your ability to operate vacation rentals in San Diego.

❌ Operating Without a Valid License $1,000+ per violation

The city actively monitors platforms and issues citations. Airbnb and VRBO will delist your property immediately upon detection. This is the most serious violation — the city can audit retroactively.

❌ Failing to Collect or Remit TOT 25% penalty + interest

Back taxes plus a 25% penalty plus accruing interest. The city can audit up to 3 years back. Even if guests paid TOT to Airbnb or VRBO, you remain responsible for verifying proper remittance.

❌ Accepting 1-Night Bookings License suspension risk

Tier 3 and Tier 4 licenses require 2-night minimums with zero exceptions. Even accidental 1-night bookings count as violations. Your management company must enforce this at the platform level, not after the fact.

❌ Multiple Neighbor Complaints License revocation risk

Three verified complaints within 2 years can result in non-renewal. Noise violations, parking issues, and unruly guests all trigger the complaint process. Prevention requires 24/7 guest management and enforceable house rules.

❌ Operating Under the Wrong Tier License invalidation

Renting whole-home under a Tier 1 or Tier 2 primary residence license, or exceeding day limits, invalidates your license. You’ll need to reapply — and may lose eligibility if caps have been reached in your tier.

❌ Expired License Renewal Immediate delisting

Operating after expiration is treated as operating without a license. Platforms delist immediately. Renewals open 60 days before expiration — missing this window can mean weeks or months of lost revenue.

🏖️

Mission Beach Exception: Tier 4 Licensing

Mission Beach operates under Tier 4 STRO licensing, with a cap of 30% of housing units — far higher than the 1% cap citywide. All Tier 4 licenses are currently issued, and licenses are not transferable, meaning they cannot be purchased with a property or acquired from a previous owner. The only path to a Mission Beach STRO license is joining the city waitlist. Read the complete Mission Beach Tier 4 guide →

Common Questions

STRO Licensing FAQ

Individuals are limited to one STRO license. However, separate legal entities — LLCs, trusts, corporations — can each hold their own license, allowing strategic ownership structures for owners with multiple properties while remaining fully compliant.
Tier 3 licenses (La Jolla, Pacific Beach, Ocean Beach, and most of the city) are currently available on a first-come, first-served basis. Tier 4 licenses (Mission Beach only) are fully issued and not transferable — they cannot be bought, sold, or passed along with a property sale. The only way to obtain a Mission Beach STRO license is to join the city waitlist. Read our full regulations post for updates →
You cannot legally operate until renewed. Platforms like Airbnb and VRBO will delist your property immediately. The city may issue citations for operating without a valid license. Renewals open 60 days before expiration — apply promptly to avoid any gap in legal operation.
Yes. In addition to your STRO license, you need a San Diego Business Tax Certificate. This is a separate requirement for all businesses operating in the city. Both documents must be current and displayed properly to maintain full compliance.
