Are vacation rentals legal in Mission Beach?
Yes, short term, or vacation rentals, are legal in Mission Beach. The question is: Are they restricted to a certain zone, or area, and what sort of licensing do you need in order to operate legally?
In Mission Beach, vacation rentals are currently legal throughout the city. However, owners are required to register for a Transient Occupancy Tax Certificate. This is a registration number which ensures you are paying the 10.5% tax on the total of a booking to the City of San Diego, with audits possible every other year.
Additionally, beginning in 2023, the City of San Diego will require a vacation rental license in order to operate a short-term rental. There is a cap on the amount of licenses which will be awarded by the city. Plus, there will be a lottery to determine who receives a license. Therefore, any duration fewer than this period would be considered a short-term stay. In some instances, there is a minimum-night stay as well, typically at least three nights. However, certain cities, homeowner associations and complexes may set their own minimums as well.

About Mission Beach, California
The Beginning
Mission Beach is a popular tourist destination built on a sandbar between the Pacific Ocean and Mission Bay, south of Pacific Beach and directly across the channel/jetty from Ocean Beach. Spanning almost two miles of oceanfront, it is home to thousands of homes, many of which are beach rentals.
The most prominent section of Mission Beach is the boardwalk. One boardwalk runs along the oceanfront, while there is also one which follows the bay front. The main street through Mission Beach is Mission Boulevard. The community is divided into South Mission, a peninsula, and North Mission. Historic Belmont Park separates North and South Mission Beach.
Many of the homes in Mission Beach were constructed from 1920 through 1940, as summer cottages. Today, the area still thrives on tourism and events.
Due to problems with developing structures on sand, Mission Beach developed later than the neighboring towns of Ocean Beach to the south and Pacific Beach to the north. Encouraged by land sales in the other local towns, including a new bridge linking Mission Beach with Ocean Beach, John D. Spreckels made small plots of land available for sale.
Due to the size of these lots, Mission Beach is the most densely developed residential community in San Diego. Additionally, thanks to the small dimensions of the area, including the size of the lots, it also has the smallest lots in the city, ranging from 1,250 square feet to 2,400 square feet. More recently, these lots have been purchased, combined and redeveloped as larger lots, including complexes and subdevelopments. Furthermore, a majority of the properties and structures in the area have been redeveloped into multi-story properties.
History & Attractions
Some of the most famous attractions near Mission Beach include SeaWorld and the historic Belmont Park amusement park. Belmont Park was originally named the Mission Beach Amusement Center by John D. Spreckels in 1925, to help boost real estate sales and to promote his electric railway. To this day, Belmont Park features the original wooden Giant Dipper Roller Coaster, built with the park in 1925, as well as multiple newer rides, games, arcades and restaurants.
Designed by architect Frank Walter Stevenson, The Mission Beach Plunge in Belmont Park, a 60-foot-by-175-foot saltwater swimming pool, also opened in 1925. The Plunge building and pool was built to resemble the Spanish Renaissance architecture found in San Diego’s Balboa Park. Additionally, the changing rooms appear in the iconic 1980’s film Top Gun. The Mission Beach Plunge, now called Plunge San Diego, and the Giant Dipper are the only remaining attractions left from the original park.
Activities
There is no limit to the beach and outdoor activities in and around Mission Beach. Along with being able to relax on the oceanfront beach, or bayfront beach, there is plenty of room for water sports, such as surfing, stand-up paddle boarding, kite surfing, parasailing, boat rentals, and freestyle diving.
Additionally, if you feel talented enough, head down to the famous volleyball courts in South Mission Beach and see how long you can hold court. A word for the wise, play on the outer courts to avoid running into professional volleyball players. If your game isn’t ready for that type of competition, there are plenty of other courts lined throughout the area, including spots to hand your own net.
Next, there is the Mission Bay Aquatic Center on Santa Clara Place. This is the perfect location to rent equipment, or sign up for classes for surfing, sailing, wakeboarding, wake surfing, stand-up paddle boarding, waterskiing, rowing, kayaking, and windsurfing. Located at the south end of Belmont Park, is Fit Mission Beach, a full-service beachside fitness center, complete with cardio equipment, weights, fitness classes, aquatic classes, yoga and more.
